The second paragraph of Article 7 of the Electronic Procurement Implementation Regulation regarding the registration on Electronic Public Procurement Platform (EKAP) of natural and legal persons who will participate in procurement procedures provides:
“It is mandatory to submit the following documents and information to the Public Procurement Authority as a supplement to the protocol to register on EKAP:
a) In case of natural persons;
1) The original or notarized copy of the document demonstrating being enrolled in a chamber, which is taken in the same year as the registration of protocol and taken from chamber of commerce and/or industry or chamber of merchants and craftsmen or relevant professional chamber in which he/she is enrolled,
2) Notarized specimen signature form,
3) If the protocol is signed by an attorney, notarized letter of attorney issued for attorney and notarized specimen signature form of the attorney,
4) Notarized letter of attorney and notarized specimen signature form of persons authorised to make transactions severally using e-signature on behalf of the natural person.
b) In case of legal persons;
1) The original or notarized copy of the document demonstrating that the legal person is enrolled in a chamber, which is taken in the same year as the registration of protocol and taken from chamber of commerce and/or industry in which it is enrolled pursuant to relevant legislation,
2) Notarized list of authorized signatures of the legal person,
3) If the protocol is signed by an attorney, notarized letter of attorney issued for attorney and notarized specimen signature form of the attorney,
4) Notarized letter of attorney and notarized specimen signature form of persons authorised to make transactions severally using e-signature on behalf of the legal person.”
In accordance with this provision, the procedures and principles regarding registration of foreign natural and legal persons on EKAP have been determined by the Public Procurement Board decision no. 2018/DK.D-357 dated 13.11.2018.
In this regard, the following decisions are taken:
– In the registration process of foreign natural or legal persons on EKAP, identity validation of foreign natural or legal persons can be done by using either foreign identification number or potential tax identification number, whichever is relevant; foreign identification number can be obtained from General Directorate of Civil Registration and Citizenship Affairs and potential tax identification number can be obtained from tax offices,
– Registration on EKAP can be done through submission of documents issued pursuant to its own national legislation, which are equivalent to those specified in the Article 7 of the Electronic Procurement Implementation Regulation, by these persons in accordance with the rules of procurement implementation regulations on requirements as to form regarding submission of documents.
